Florida’s “Heartbeat Protection Act,” a cornerstone of the state’s robust pro-life legislation, has significantly impacted the number of births in the state. Since its enactment, the Florida Agency for Healthcare Administration reports that over 23,000 babies have been born who might otherwise have been aborted. This surge in births comes after the implementation of the law which Governor Ron DeSantis signed in 2023, positioning Florida as one of the nation’s most pro-life states.

The “Heartbeat Law” stipulates that the protection of unborn babies begins once their heartbeat is detectable, typically between six to eight weeks of gestation. The legislation not only aims to protect the unborn but also extends substantial support to expectant mothers and families. It mandates that a pregnant woman be offered the chance to view an ultrasound and includes a 24-hour reflection period (except in emergencies) to ensure informed consent. Notably, the law encompasses exceptions for rape, incest, and human trafficking, provided these circumstances are officially documented.

This law coincides with Florida’s 15-week abortion ban, which also includes provisions to protect the life of the mother in cases such as ectopic pregnancies, fatal fetal abnormalities, or significant risks of physical impairment to the woman. These measures collectively underscore the state’s commitment to both maternal and infant health.

Florida’s legal stance on abortion underwent significant judicial scrutiny, culminating in a 6-1 Florida Supreme Court ruling that the state constitution does not guarantee a right to abortion. This decision bolstered the implementation of the “Heartbeat Protection Act.”

The introduction of these laws has altered Florida’s status as a previously sought-after destination for abortions in the Southern United States. According to Liberty Counsel, a non-profit legal organization, the number of non-resident abortions has decreased by almost 51% since the law took effect in May 2024. Mat Staver, founder and chairman of Liberty Counsel, remarked on the legislation’s impact, noting that “the news of fewer abortions in Florida…is evident that pro-life laws are saving lives and protecting women.”

In addition to legal measures, the state has allocated $30 million in recurring funds to aid pregnant women and their families, providing essential items such as clothing, cribs, and car seats.
